Dichotomy between the Sovereignty of Nation States and International Law

A PhD studentship is available within the area of international public law and human rights at the division of Law, University of West of Scotland. The successful candidate would be prepared to examine the dichotomy between the sovereignty of nation states and international law. Particular focus would be upon the issues raised by the House of Lords decision in Al-Skeini v Secretary of State for Defence (2007), which decided that the Human Rights Act 1998 could apply to actions by the British Government affecting foreign nationals outside UK territory. This has implications for humanitarian intervention in other countries, the rights of refugees and other politically-sensitive areas.
The project will build upon the existing experience and research interests of the law group. The group has a small postgraduate community and an excellent support network for both new and experienced researchers. The successful candidate will also be given the opportunity to participate in the provision of undergraduate law modules.
The supervisory team
Dale McFadzean is a researcher in the field of public law and is the author of several textbooks on public law topics, as well as substantial entries for the prestigious Stair Memorial Encyclopaedia. He was the Business School's New Researcher of the Year in 2007 and his work has been submitted for RAE2008.
Valerie Finch is a researcher in the field of public law and human rights. She is the co-author of textbooks on Human Rights Law and Administrative Law.
