Mitigation and Appeals

MITIGATION

WHAT IS MITIGATION?

The Mitigation Process has been designed to take into consideration any negative events that may have stopped you doing your best in your assessments. You can submit your case to the Mitigation Panel for consideration where it will be treated in the strictest confidence. If successful, you will be entitled to resubmit or resit the assessment(s) in question as a new and fresh attempt. The regulations can be found on the Student Administration site.

WHEN is mitigating the correct procedure for me?

You should mitigate where you believe your performance on an assessment has been adversely affected by mitigating circumstances, such as an illness. Wherever possible, you must be able to corroborate such circumstances with supporting evidence from an independent 3rd party eg GP, lawyer, church/religious leader.

HOW DO I MITIGATE?

You will need to fill in and hand in the Mitigation form along with any evidence by the deadline stated on the form. There are Guidance Notes to accompany the form and both are available from the Student Administration site.

how can WE help ?

We can offer guidance as to whether you have grounds to submit a Mitigating circumstances form, and assist by reading the application, before submission. In order for the Student Support Adviser to assist with this, you could prepare a draft of the Mitigation Form prior to your appointment.

The Adviser is unable to write to the Panel on behalf of students other than in very exceptional circumstances.

APPEALS

What is an Appeal?

The University gives you the right to appeal against the decisions of the Programme Panel under certain circumstances after you have received official notification of your results. An appeal is heard by a small panel who will determine whether further attempts are justified. It is important that you read the Appeals Procedure carefully if you are thinking of appealing. These regulations (Regulation 13) are also available from the Library, Student Administration and Departmental Offices.

WHEN IS AN APPEAL THE CORRECT PROCEDURE FOR ME?

There are two grounds on which you may appeal:

  • if your performance was adversely affected by illness or other factors which you were unable or unwilling, on valid grounds to divulge to an Mitigation Panel before it met
  • if there was a material administrative error, or the examination was not conducted according to the Regulations.

You may not appeal on any grounds which:

  • have already been considered by the Mitigation or Programme Panel concerned,
  • could have been considered had notice of the grounds been given prior to the meeting of the Programme Panel and you have no valid reason for failing to give such notice,
  • disputes the academic judgement of the Panel.

HOW DO I APPEAL?

If you wish to submit an appeal this must be done within 10 days of the date of notification of your results.

You should submit a written statement and any supporting evidence to the Vice Principal (Learning & Teaching), along with particular reference to your reasons for not pursuing this through the Mitigation Process (if applicable).

* If you are eligible to graduate when you lodge an appeal, you will be withdrawn from the graduation roll and unable to graduate whilst the appeal is ongoing.
